Hace algunos domingos en el programa "El mundo de Pirry" salió el caso del asesino en serie Luis Alfredo Garavito, lo cual ha generado una gran polémica en el país debido a que este asesino de más de 180 niños podría quedar en libertad en tan sólo algunos quinquenios.
El caso ha puesto en la cuerda a floja al sistema judicial colombiano, pues en la mente de todo ciudadano es inconcebible que un criminal de esta talla pueda salir tan pronto de la cárcel, con un grado tan alto de impunidad, cuando otros delincuentes con delitos mucho menos graves tienen que cursar condenas más largas.
Además todavía se abre la posibilidad de que pueda salir y volver a delinquir.
En esta ocasión he querido analizar este caso pero desde una perspectiva un poco distinta, quizá tomándonos el atrevimiento de asumir el papel de jueces en un asunto tan delicado como este.
La cuestión que planteo, es que dadas mis convicciones creo en que las personas, aun los peores criminales pueden ser concientes de sus crímenes y asumir una actitud de cambio y verdaderamente cambiar. Al observar el programa de Pirry, tratando de mantener una postura analítica y no dejándome encolerizar por el significado de tantos homicidios y de formas tan atroces, percibí que Garavito realmente notaba un cambio de actitud y todo lo que decía y hacía parecía concordante con ese cambio. En ocasiones me parecía que Garavito no era conciente de la magnitud de sus delitos, pero también por momentos pensaba qué haría yo si en algún momento cometiera algo tan grave que no pudiera reversar, creo que trataría de reparar el daño, pero no podría seguir castigándome toda la vida por lo que hice en un momento.
En todo caso el hombre me pareció consecuente con un cambio de actitud: Pedía disculpas a los familiares (aunque eso no solucione nada), colaboraba con la justicia, reportaba buen comportamiento en la cárcel, accedió a las preguntas y confesó cosas incluso incómodas de confesar para cualquier hombre, mencionó su deseo de formar una familia, se notaba lúcido, etc.
Por otra parte me sorprendió ver a una multitud de sicólogos que mencionaban que una persona de la calaña de Garavito no podría regenerarse. Y otra multitud de amigos y conocidos que mencionan que una persona así, es supremamente hábil para engañar y manipular a las personas.
Mi conclusión personal al respecto, es que definitivamente el sistema judicial colombiano es una pifia, la pena que se le imputa es una burla a las familias de los niños asesinados. Por otra parte, aunque Garavito se haya rehabilitado creo que nunca podrá tener una vida normal como él parece desear y toda su vida llevará tras de sí la sombra de todo lo que hizo.
Sin embargo, si Garavito ha manifestado verdaderamente un cambio, ¿qué debe hacer para que la sociedad quede satisfecha?, ¿qué pena se le debe imputar? Las cárceles colombianas son conocidas debido a que en vez de regenerar, corrompen más a la gente que a ellas llegan. La idea del sistema penitenciario es que los presos se regeneren. ¿Qué hacer si el peor asesino de toda la historia colombiana se ha verdaderamente regenerado?
